This Data Processing Agreement (the “DPA”) and its Annexes between Equate Digital Media and you outline our mutual understanding regarding the Processing of Personal Data on your behalf in connection with the Equate Digital Media Subscription Services as detailed in the Equate Digital Media Customer Terms of Service (collectively referred to as the “Agreement”).

The DPA is supplementary to and forms an essential part of the Agreement, becoming effective upon its inclusion within the Agreement, an Order, or an executed amendment. In the event of any conflict or inconsistency between the terms of the Agreement and this DPA, the provisions of the DPA will prevail to the extent of such conflict or inconsistency.

We may update these terms periodically. If you maintain an active Equate Digital Media subscription, we will notify you of changes via email (if you have opted to receive notifications through the link in our Master Terms) or through in-app alerts. Archived versions of the DPA can be accessed here.

The term of this DPA will align with the term of the Agreement. Any terms not explicitly defined in this DPA will carry the meanings assigned in the Agreement.
